Personal Training Agreement

1) This agreement is made on {{order_create_date}} by and between {{billing_first_name}} {{billing_last_name}} of {{billing_city}}, {{billing_state}} (“Client”) and Limitless Training, LLC (“Instructor”).

The agreed upon package of services will be provided in consideration of the flat fee of {{order_total}} (the “Fee”) for personal training as noted in the orders details below.

Client hereby grants Instructor express permission to charge the Fee to Client’s {{payment_method_title}} as Payment Method as entered at checkout at the interval for any remaining installments, if applicable.

I, {{billing_first_name}} {{billing_last_name}, understand and acknowledge that Limitless Training, LLC and it’s associated “Baby Break” is not a licensed childcare provider and that the temporary supervision of my child/children is a service Limitless Training may provide only while I am present at the training location for the sole purpose of participating in Limitless Training personal training sessions.

I hereby grant permission for my child to be temporarily supervised by Limitless Training (including its officers, employees, representatives, agents, contractors, volunteers, successors and assigns - collectively, "Limitless Training”) while I participate in in-person training.

I hereby hold harmless, waive and release Limitless Training from any and all liability in connection with any personal injury or property damage or loss that may occur while my child is supervised by Limitless Training at the training location. I agree not to sue Limitless Training and release all rights to make a claim against or sue Limitless Training in connection with the supervision of my child. I further agree to defend and indemnify Limitless Training for any and all claims arising in connection with Limitless Training's supervision of my child.

I understand the following:

If my child should become inconsolable or present any behavioral issues during the training session, it is my responsibility to attend to my child.
It is my sole responsibility to inform Limitless of any and all information about any medical information or behavioral issues my child may have that may impact my child’s health or well-being.
“Baby Break” services are strictly a supervisory service and do not include:
- Administering any food, beverage, medication or first aid treatment to my child.
- Attending to diaper changes and/or clothing changes for my child.
- Accompanying my child to the bathroom.
- Initiating and/or participating in play, games, entertainment or recreational activities with my child.

I have read and understood the foregoing assumption of risk, and release of liability, and I understand that by signing below, I also agree to indemnify Limitless Training for any liability for injury or death of any person and damage to property caused by my child/children. I UNDERSTAND THAT BY SIGNING THIS FORM I AM WAIVING VALUABLE LEGAL RIGHTS.

This Agreement shall be governed by the laws of the State of New Jersey, and any claim or dispute that arises under this Agreement shall be resolved exclusively by binding arbitration in Newark, New Jersey with the American Arbitration Association.
